These Terms of Service (“Terms”) govern your access to and use of the Auto Lead Warmer Google Sheets Add-on (the “Service”), developed under the brand hireFrankie. By installing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Overview

Auto Lead Warmer is a Google Sheets add-on designed to automate post-event lead engagement, including lead profiling, personalized email generation, and scheduled email sending.

2. Eligibility

  • You must have a valid Google Account and sufficient access rights to install and use Google Workspace Add-ons.

  • You must be at least 18 years old or the legal age of majority in your jurisdiction.

3. Use of the Service

  • You agree to use the Service solely for lawful purposes and in compliance with applicable laws and regulations.

  • You are responsible for ensuring that your use of the Service complies with Google’s policies, including Gmail sending limits and Google Workspace Marketplace policies.

  • You are solely responsible for the accuracy of the data you input into Google Sheets and for the content of the emails you choose to send.

  • The Service requires access to your Google Sheets and Gmail account through OAuth scopes.

  • Data processed includes lead information, seminar information, and outgoing emails. Reply detection is limited to matching replies to specific sent messages.

  • External APIs (such as Perplexity) may be used to generate content based on minimal context you provide.

5. User Responsibilities

  • You are responsible for managing your Sheets data, including deleting or anonymizing personal data as required.

  • You must obtain consent from your contacts where legally required before sending them emails.

  • You must not use the Service to send spam, unsolicited bulk communications, or unlawful content.

  • You are responsible for monitoring Gmail sending quotas and ensuring compliance with email regulations (such as CAN-SPAM, GDPR, or local equivalents).

6. Intellectual Property

  • The Service and all related software, features, and branding are the intellectual property of hireFrankie.

  • You are granted a limited, non-exclusive, non-transferable license to use the Service within Google Sheets.

  • You may not copy, modify, reverse engineer, sell, or distribute the Service without prior written consent.

7. Service Availability and Limitations

  • The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation.

  • Functionality may be subject to technical limitations of Google Apps Script, Gmail, or external APIs.

  • We reserve the right to modify, suspend, or discontinue the Service at any time without liability.

  • To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied.

  • We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

  • To the maximum extent permitted by law, hireFrankie shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or interruption of business.

  • Our total liability for any claim relating to the Service shall not exceed USD $50 or the amount you paid for the Service (if any), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless hireFrankie and its affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your misuse of the Service,

  • Your violation of these Terms,

  • Your violation of applicable laws or third-party rights.

11. Termination

  • You may stop using the Service at any time by uninstalling the add-on and revoking its access in your Google Account.

  • We may suspend or terminate your access if you violate these Terms or use the Service unlawfully.

  • Upon termination, your rights under these Terms will cease immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of law principles.

We may update these Terms to reflect changes in functionality, law, or business practices. Updates will include a revised version and effective date. Continued use of the Service after updates constitutes acceptance.
